Behaviors including sexual harassment, sexual misconduct, dating violence, domestic violence, and stalking, as well as retaliation for reporting any of these acts violate Title IX and are not tolerated at EOU.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-eastern-navy-color has-css-opacity has-eastern-navy-background-color has-background is-style-wide\"\/>\n\n\n\n<div class=\"wp-block-group has-eastern-navy-background-color has-background\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading has-white-color has-text-color\">Athletics Compliance Areas<\/h3>\n\n\n\n<p class=\"has-normal-font-size\">In order to comply with Title IX, EOU must meet all three parts, however there is flexibility within the three areas.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Participation &#8211; whether the selection of sports and the levels of competition effectively accommodate the interests and the abilities of both sexes<\/li>\n\n\n\n<li>Scholarships &#8211; whether men and women are provided equitable amounts of scholarships aid<\/li>\n\n\n\n<li>Treatment and benefits provided to male and female athletes<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<h3 class=\"wp-block-heading has-eastern-navy-color has-text-color\"> Participation <\/h3>\n\n\n\n<p class=\"has-eastern-navy-color has-text-color has-normal-font-size\">In order to determine whether an institution&#8217;s selection of sports and the levels of competition effectively accommodate the interests and abilities of both sexes, the Office of Civil Rights requires that it satisfy at least one of the following three tests:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li> Does the institution provide intercollegiate level participation opportunities for male and female students in numbers substantially proportionate to their respective enrollments, or<\/li>\n\n\n\n<li> Does the institution have a history and continuing practice of program expansion which is demonstrably responsive to the developing interests and abilities of the members of the underrepresented sex, or<\/li>\n\n\n\n<li> Does the institution&#8217;s present program fully and effectively accommodate the interests and abilities of the members of the underrepresented sex? <\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group has-eastern-navy-background-color has-background\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading has-white-color has-text-color\"> Scholarship Participation Criteria <\/h3>\n\n\n\n<p class=\"has-white-color has-text-color has-normal-font-size\">These areas have many sub components but in general you look at: are the disparities, if any significant? Does the difference in benefits or services have a negative impact on athletes of one sex when compared with benefits and services available to athletes of the other sex?<\/p>\n\n\n\n<p class=\"has-white-color has-text-color has-normal-font-size\">Significant Disparity: so substantial as to deny equal opportunity of one sex<\/p>\n\n\n\n<p class=\"has-white-color has-text-color has-normal-font-size\">Non-significant: evidence to be evaluated<\/p>\n\n\n\n<ul>\n<li>Definitions of Participation differs for purposes of scholarship analysis\n<ul>\n<li>count student athletes once regardless how many sports they play<\/li>\n<li>determine % of male to female athletes<\/li>\n<li>if 50% of athletes are female then 50% of scholarships should go to females<\/li>\n<li>any disparity in excess of 1% raises an inference of discrimination<\/li>\n<\/ul>\n<\/li>\n<li>Other benefits and opportunities\n<ul>\n<li>equipment and supplies<\/li>\n<li>scheduling<\/li>\n<li>travel and per diem<\/li>\n<li>tutors<\/li>\n<li>coaches<\/li>\n<li>facilities<\/li>\n<li>medical and training services<\/li>\n<li>housing<\/li>\n<li>publicity<\/li>\n<li>support services<\/li>\n<li>recruiting<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<h3 class=\"wp-block-heading has-eastern-navy-color has-text-color\">Permissible Differences<\/h3>\n\n\n\n<p class=\"has-eastern-navy-color has-text-color\" style=\"font-size:18px\">Title IX law is under continual review by the Division of Athletics.
